Terms & Conditions
These Terms & Conditions set out the principles governing auctions conducted by Auction Mann (“the Auctioneers”) and apply to everyone acting as a seller, bidder or buyer. By offering an item for sale, bidding or completing a purchase, you agree to be bound by them. Placing a bid may make you responsible for buying the lot; once made, a bid can only be withdrawn at the Auctioneers’ discretion and with the seller’s agreement.
Buyer’s premium
Cars, vehicles, plant, machinery and number plates: a sliding buyer’s fee from 15% plus VAT (18% total) on lots up to £2,000, down to 5% plus VAT (6% total) above £5,000. Art, furniture, memorabilia, electronics and household goods: 20% plus VAT @ 20% (24% total). Internet bidding incurs a further 3.6%. Please call for jewellery and precious metals / stones rates. Bidding
Each item is sold to the highest bidder; in the event of a dispute between bidders the item may be re-offered at the Auctioneer’s discretion. The Auctioneers may refuse any bid without giving a reason and may act as agents for prospective buyers. Their decision on all matters concerning the auction is final. Items are sold without reserve unless the owner notifies the Auctioneers of a reserve before bidding begins.
Payment
All buyers must give their name and address and, if the Auctioneer requires, pay a deposit of one quarter (or another portion) of the price as part payment. The balance must be paid no later than midday on the Thursday following a Wednesday sale, and midday on the Monday following a Friday sale. If a buyer fails to comply with the conditions of sale, any deposit is forfeited and the lot may be resold, with the defaulting buyer liable for any loss.
Risk & collection
Risk passes to the buyer on the fall of the hammer. Buyers are responsible for removing all items at their own expense. Lots must be removed by Monday 5pm or a daily charge of £15 per day will be applied and donated to the Home of Rest for Old Horses. The Auctioneers accept no liability for loss or damage to any item entrusted to them.
Vehicles
Sellers must tell the Auctioneers at listing if a vehicle is subject to a Hire Purchase agreement. Odometer mileage is only guaranteed if the Auctioneers say so explicitly during the sale. Vehicles described as Direct from Company, Main Agent Direct, Trade Vehicle or Sold as Seen, including insurance total losses, are sold without any guarantee; the buyer must make sure such a vehicle is roadworthy before using it on public roads. Where a vehicle has been treated as an insurance total loss, the Auctioneer will announce it. Buyers pay an additional indemnity sum on each vehicle against loss within one month from theft or an outstanding Hire Purchase agreement, limited to the purchase price and subject to VAT.
Warranties & disputes
Any warranty is given only as stated by the Auctioneer at the time of sale, on behalf of the seller. Objections must be made in writing to the Auctioneers’ office no later than Wednesday midday after a Saturday sale. In a dispute over mechanical condition, age or warranty, the Auctioneers may appoint a qualified person whose findings are final, with the cost paid by the party at fault. The buyer’s recourse is against the seller alone.
Sellers
Sellers are paid the price less commission within 3 days of the sale. If an item is returned, commission remains payable as if the sale had completed; in a blatant breach of warranty (of which the Auctioneer is sole arbiter) double the standard commission is payable before the item is returned.
